Privacy Policy

1. Data Collection

English with Thomas collects the following personal information when users sign up: name, email address, and (optionally) phone number for SMS alerts.
Payment information is only stored if a user selects a monthly subscription. Payment processing is handled by Wix Payments or third-party services like PayPal, Apple Pay, and Klarna.
Forum posts made by users are publicly visible and stored on the website if the user chooses to post.
Cookies are used for website analytics and login sessions. Users may opt out of analytics cookies via the pop-up banner, but functional cookies for login sessions are required.

2. Data Usage

Names, emails, and payment details are used for lesson scheduling.
Names and emails are also used for communication and marketing purposes.
Phone numbers (if provided) are used exclusively for SMS lesson reminders.
Lessons are not recorded, but the Krisp app is used for noise cancellation and generates transcriptions for Thomas to reference for lesson planning. Students may record lessons but must notify Thomas beforehand.

3. Data Access & Storage

Thomas and Wix have access to user data for the purposes of running the website and processing payments.
Payment details are stored only if a user selects a monthly subscription or chooses to save their payment details via Wix Payments or a third-party payment provider. English with Thomas does not have direct access to payment details.

4. Data Deletion

Users may delete their accounts (and all associated data) via account settings.
Users may also request deletion by emailing support@englishwiththomas.net

Cancellation & Refund Policy

Students must cancel or reschedule at least 12 hours in advance to avoid fees.
Last-minute cancellations (12 to 1 hour prior): 25% fee.
Cancellations less than 1 hour prior: 50% fee.
No-shows (more than 10 minutes late): No refund.
Refunds for emergency cases require manual review and are at Thomas' discretion.
If Thomas cancels a lesson, the student receives a full refund.
Refunds may take time to process depending on the payment provider (Wix Payments, PayPal, Klarna, or Apple Pay).

Terms of Service

1. Eligibility & Registration

English with Thomas is open to users from any country. While lessons are primarily advertised to adults, there are no official age restrictions.
Users may sign up for one-time lessons or subscribe to a monthly plan.

2. Payments & Subscriptions

Payments for individual lessons must be made upfront.
Monthly subscriptions are billed on a recurring basis.
All payments are processed via Wix Payments, PayPal, Apple Pay, or Klarna.

3. Cancellations & Refunds

Lessons canceled more than 12 hours in advance receive a full refund.
Lessons canceled 12 to 1 hour before start time incur a 25% fee.
Lessons canceled less than 1 hour before start time incur a 50% fee.
No-shows (failure to join within 10 minutes of lesson start) are non-refundable.
Refunds for emergency situations are subject to Thomas' discretion.

4. Code of Conduct & Account Restrictions

Users must behave respectfully during lessons and in the website’s forum.
Inappropriate behavior (harassment, offensive language, etc.) will result in warnings, temporary restrictions, or permanent bans depending on severity.
The forum is for educational discussions related to English learning. Repeated rule violations may result in account suspension or termination.

5. Disclaimer of Guarantees

English with Thomas does not guarantee fluency or specific learning outcomes.
Learning progress depends on student effort and consistent study habits.

6. Modification of Terms

Terms may be updated as necessary (e.g., due to feature changes). Users will be notified via email and website notifications.

Behavior & Attire Policy

Respect for Thomas and fellow students is required at all times.
Arrive 5 minutes before lesson start to check equipment and connection.
Appropriate attire is required: Fully clothed, no face coverings unless required by culture/religion.
Inappropriate behavior (harassment, offensive language, sexual advances) will result in warnings or immediate termination of lessons. Severe cases may result in bans.
Students may record lessons but must notify Thomas beforehand.

Payment Policy

Accepted payment methods: Credit/Debit cards, PayPal, Apple Pay, Klarna.
Recurring payments: Only for monthly subscriptions.
Late payments: Lessons are paid in advance. If a student does not attend within 10 minutes of the start time, the lesson is forfeited.
Payment storage: Wix securely stores payment details for subscriptions. English with Thomas does not directly store any payment information.

Dispute Resolution Policy

Students may file complaints via support@englishwiththomas.net
Refunds are only issued if the dispute aligns with English with Thomas' policies.
Legal Waiver: English with Thomas is not responsible for harm resulting from a student's environment during lessons.
Transcription Notice: By using this service, students consent to Krisp's automatic transcription for lesson planning purposes.

Website & Forum Policy

Forum discussions must be educational and primarily related to English learning.
First violation: Warning.
Second violation: Temporary suspension.
Third violation: Permanent ban.
Severe violations (e.g., hate speech, defamatory content) may result in an immediate ban.
User-generated content may be featured in emails or blog posts, but authorship will be credited to the original poster.

Free Course Materials Policy

Non-Accreditation Statement: The free course materials provided on English with Thomas are for educational purposes only. This website is not an accredited institution, and any certificates earned upon course completion do not serve as proof of formal education or qualification for employment.
Educational Nature: These materials are created by a single English tutor and are designed to aid in personal language development. They are not collegiate-level materials and should not be considered as equivalent to formal coursework.
Accuracy Disclaimer: While every effort is made to ensure accuracy, English with Thomas cannot guarantee that all content is free of errors. The website owner is not responsible for any inaccuracies that may appear in the course materials.
Certificates & Badges: Students who complete a course will receive a certificate for personal achievement. These certificates are purely novel and are not recognized by any official institutions. Additionally, students earn profile badges for completing courses. These badges are for on-site display only and hold no real-world value or professional significance.
